Malaysia is about to embark upon new legislation that allows for adjudication. It is not, of course, the first jurisdiction to do so. Adjudication has been a part of the legal system in England & Wales since 1996 and in NSW, Australia since 1999. There are many lessons to learn from the experiences of these 2 jurisdictions , including whether the system has worked as envisaged, what has been the effect of adjudication on other forms of dispute resolution or litigation and the desirability or otherwise of the rough and ready nature of the method of adjudication on perceptions of justice by industry players. Rashda Rana, President of the Chartered Institute of Arbitrators and the Vice Chair of the Society of Construction Law Australia, has been heavily involved in adjudication for many years and she will discuss these issues amongst others.
